Agreement to Terms

By accessing and using Qirafent ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service. Your continued use of the Platform constitutes acceptance of these terms and any future modifications.

Platform Purpose and Description

Qirafent is a demonstration platform that provides access to interactive entertainment software for preview, educational, and entertainment purposes only. The Platform is specifically designed to:

Age Restriction and Eligibility

You must be at least 18 years of age to access and use this Platform. By using Qirafent, you represent and warrant that:

• You have the legal capacity to enter into this agreement
• Your use of the Platform complies with all applicable local, state, and federal laws
• You are accessing the Platform from a jurisdiction where such access is legal

Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You specifically agree not to:

• Illegal Activities: Use the Platform for any illegal, fraudulent, or unauthorized purpose
• Security Violations: Attempt to gain unauthorized access to any part of the Platform, servers, or networks

• Harmful Activities: Engage in activities that could harm other users, the Platform, or third parties

Entertainment Only Disclaimer

CRITICAL NOTICE: All games and interactive content on Qirafent are provided strictly for entertainment, demonstration, and educational purposes. The Platform explicitly does not involve:

• No Financial Transactions: No real money transactions, purchases, or financial exchanges of any kind
• No Monetary Risk: No financial risk, loss, or gain is possible through Platform use
• No Digital Assets: No cryptocurrency, digital tokens, or blockchain-based assets are involved
• No Prizes or Rewards: No monetary prizes, rewards, or incentives are offered
• No Commercial Value: No content, achievements, or progress has real-world commercial value
• Demo Content Only: All experiences are demonstration versions without full functionality

Third-Party Content and Services

The Platform contains embedded games and content provided by third-party developers, including but not limited to ELK Studios. Important considerations:

• Third-Party Terms: Embedded content may be subject to additional terms and conditions from their respective creators
• No Control: Qirafent does not control and is not responsible for third-party content, its availability, or functionality
• Content Changes: Third-party content may be modified, updated, or removed without notice

Intellectual Property Rights

Intellectual property rights are clearly defined and protected:

• Platform Design: The Qirafent platform design, layout, branding, and original content are owned by Qirafent
• Embedded Content: Games and related assets remain the property of their respective creators and licensors
• Usage Rights: You are granted a limited, non-exclusive, non-transferable right to access and use the Platform for personal entertainment
• Restrictions: You may not reproduce, distribute, modify, or create derivative works from Platform content without explicit permission
• Trademark Protection: All trademarks, service marks, and logos are protected intellectual property

Platform Availability and Modifications

Qirafent reserves the right to:

• Modify Services: Update, modify, or discontinue any aspect of the Platform at any time
• Maintenance: Perform scheduled or emergency maintenance that may temporarily affect availability
• Content Updates: Add, remove, or modify available games and content
• Technical Changes: Implement technical improvements or changes to enhance user experience
• Policy Updates: Modify these Terms of Use with appropriate notice to users

Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties, express or implied. Qirafent specifically disclaims:

• Merchantability: Warranties of merchantability or fitness for a particular purpose
• Accuracy: Warranties regarding the accuracy, reliability, or completeness of content
• Availability: Warranties that the Platform will be uninterrupted, error-free, or always available
• Security: Warranties regarding the security of data transmission or storage
• Third-Party Content: Any warranties related to embedded third-party games or content

Limitation of Liability

To the maximum extent permitted by law, Qirafent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or other intangible losses
• Business interruption or loss of business opportunities
• Damages resulting from use or inability to use the Platform
• Damages arising from third-party content or services
• Any damages exceeding the amount paid by you to use the Platform (which is zero for free services)

Indemnification

You agree to indemnify, defend, and hold harmless Qirafent, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Platform or violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or transmit through the Platform
• Your violation of any applicable laws or regulations

Termination

Qirafent may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms of Use
• Conduct that is harmful to other users or the Platform
• Suspected illegal or fraudulent activity
• Technical or security concerns

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration or in courts of competent jurisdiction.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms constitute the entire agreement between you and Qirafent regarding the Platform.
